Abandoned housing project by unlicensed developer




Our Housing and Local Government Ministry reported there were 195 abandoned development by unlicensed developers. What can be done to reduce the incidents? Through more responsible role play and improved implementation and enforcement of the laws, perhaps!

To the prospective house owners: "Visit the site of the house you are going to buy. See if you like the location and surrounding area of the neighbourhood. See for yourself the connectivity and accessibility of the location you are buying into. Visit the developer's office before you sign on the dotted lines. Ask to be shown the building plan, sales and advertisement permit and developer license before you pay the deposit".

Any responsible developer will have no problem in providing the house buyers these information. Responsible developers will not disagree to steps taken to protect the house buyers, their customers.

As most of the house buyers are not from the legal profession, they won't know much about the legal documents they are signing - the protection and validity aspect of it. Lawyers and bankers, being specialists in their chosen field, can help to make sure that the required documents are in place to protect the house buyers. This is not difficult. They have access to these information; they have the network of contacts with these information. They are in a position to help the prospective house buyers against unlicensed developers by highlighting any non-compliance of the rules. Lawyers and bankers checking and verifying the required documents for the sales of the housing project before they prepare the Sales and Purchase Agreement and Loan Agreement are good cases in point.

The existence of the laws under Housing Development Acts do not guarantee protection for the house buyers. Not even the Prime Minister can do this. So it's unfair to expect the lawyer or banker involved in the house ownership process to be able to do THAT. Thus we don't talk about THAT here, we are just talking about reducing the incidents of abandoned project by irresponsible developer. And how we can achieve that. We are talking about every role player playing his role responsibly, or in a more responsible way if anyone wanted to claim he already has been so. We are not talking about anyone playing superman.

It has been said many times, here in Malaysia, the laws to protect the house buyers, including against the irresponsible developers, are in place. What is lacking is the implementation and enforcement. This symptom of "say one thing and do another thing" need to be cured.
